BREAKING: Gibraltar loses second appeal over EU natural habitats designations

According to Gibraltarian media outlet Panorama, the Government of Gibraltar has lost its second appeal before the European Courts of Justice against an EU ruling that designated to Spain an area of British Gibraltar Territorial Waters as a Site of Community Importance (SCI) - known as the "Estrecho Oriental" - under the EU Habitats Directive.

UPDATE: 09/09/2012

Interestingly, in addition to the Government of Gibraltar not being informed about the ruling, it has emerged that one of the review panel at the ECJ was in fact Spanish! Since judges cannot rule on cases where there is an obvious conflict of interest, Rosario Silva de Lapuerta, the judge appointed to the court by Spain, should therefore not have participated in this case.
